Forged Akimat Decisions Used to Obtain Land in the Almaty Region

Facts of the change of the designated purpose of 5 hectares of agricultural land have been established

In the Almaty Region, the prosecutor’s office has identified violations in the sphere of land relations related to the use of fictitious decisions of local executive bodies, Kazinform reports.

According to the Prosecutor’s Office, in the Karasai District facts were established of the illegal change of the designated purpose of 5 hectares of agricultural land. The basis for this was forged akimat decisions. Subsequently, the specified lands were divided into 83 separate land plots.

Following a lawsuit filed by the prosecutor’s office, the Karasai District Court recognized the fictitious acts of the local executive bodies as illegal and annulled them, as a result of which the interests of the state were restored.

A similar violation was identified in the Ili District, where the decision of the akim to allocate a land plot for individual housing construction also turned out to be fictitious. By court decision, the plot was returned to state ownership.

“Based on these facts, under the coordination of the prosecutor’s office, the police department has initiated a criminal case on the grounds of a criminal offense by Part 3 of Article 385 of the Criminal Code of the Republic of Kazakhstan (manufacture and use of forged documents). Investigative actions are currently being carried out aimed at an objective establishment of all circumstances of the case,” the Almaty Region prosecutor’s office noted.

In accordance with Article 201 of the Criminal Procedure Code of the Republic of Kazakhstan, the data of the pre-trial investigation are not subject to disclosure.
